RENTAL TERMS & CONDITIONS
1. THE CONTRACT
The holiday rental contract will be signed by Katrin Carrasco Rabanal (hereinafter the Agent) in her own name and on behalf of Marbella Skol.
The contract will take effect at the moment the Agent confirms to the tenant, of receipt of the deposit, in the account of Marbella Skol.
These booking terms are governed by Spanish Laws, in case of controversy between the parties arising from the contract, both, with express waiver of their own jurisdiction, submit themselves to the jurisdiction of the Courts and Courts of Marbella
2. THE PROPERTY
The data and images published on the website are correct and respond faithfully to the condition of the apartment, however, the Agent warns that there may be small changes and accepts no responsibility for discrepancies to that effect.
3. OCCUPANTS OF THE PROPERTY
At the time of booking, the tenant must indicate the number of people who will occupy the apartment. In no case may the number of occupants exceed the agreed number. In case of excess in the number of agreed occupants the Agent may choose:
- Cancel the rental and request the immediate departure of the group, without the return to the tenant any of the amount corresponding to the days not used.
- Make an additional charge for the additional persons who want to occupy the apartment.
- Do not return the damage deposit.
Pets and animals expressly prohibited in any area of the rented property. If any pets are discovered the tenants will be subject to immediate eviction and forfeit of all monies paid
4. ARRIVALS AND DEPARTURES
The rental will begin at 4 pm on the day of arrival and will end no later than 12 pm, on the day of departure, unless otherwise agreed with the Agent. These terms are without exception.
If the property is not vacated at the agreed time, the Agent may make an additional charge of 40€ per hour.
Upon arrival, the tenant will be given the keys to the property and the details of the contact person.
5. CONDITIONS OF PAYMENT
1) 50% of the total rental cost will be paid at the time of booking.
2) The remaining 50% of the rental plus the security deposit (damage deposit) will be paid 30 days prior to occupancy. If payment is made by credit card, a charge for the deposit will be placed on the credit card during the duration of your stay and released the day after departure or up to a maximum of 7 days later.
Reservations made within 40 days prior to occupancy will require the payment of 100% of the stay plus the security deposit.
The cancellation by the tenant of the reservation will imply the loss of all the amounts paid, unless by express agreement with the Agent.
Payments must be made by one of the following means:
Bank transfer in Euros (all expenses payable by the tenant).
Credit card: Visa, MasterCard, American Express, Diners Club, etc., are accepted.
PayPal: (may incur a transaction fee).
Payments made by credit card through our payment gateway are secure and are channeled through our Owner Reservations, reservations system and are received directly by Katrin Carrasco Rabanal or by Marbella Skol, both of which are responsible for any refund or refund in your case . Owner Reservations does not receive any payment or funds from the tenant on behalf of Katrin Carrasco Rabanal or Marbella Skol.
6. CANCELLATION / REFUNDS
The tenant may only cancel the reservation in the case of ‘force majeure’. The tenant must prove this with the correct documentation. In the case of cancellation, the tenant must pay the cancellation charge, which is detailed below:
a) 25% of the amount paid when the cancellation is made more than 65 in advance to the day of arrival.
b) 40% of the deposit when the cancellation is made between 45 and 64 days before the day of arrival.
c) 60% of the deposit when the cancellation is made between 31 and 44 days before the day of arrival.
d) 100% of the deposit when the cancellation is made with 30 days or less in advance to the day of arrival.
The cancellation by the tenant of the reservation without a major cause will result in the loss for the tenant of all the amounts paid, without being entitled to any type of claim.
In case of cancellation, if the tenant submits to the Agent another person interested in the same property and the same period of time, the amount paid will be returned in full after the formalization between the Agent and the new tenant of the corresponding contract.
In the case of cancellation by the Agent, for reasons beyond the control of the Agent, the Agent will endevour to offer the tenant alternative accommodation at no additional cost. In the case where this is not possible, the tenant will be reimbursed the entire amount paid.
7. CONSERVATION AND RULES OF USE OF THE PROPERTY
The tenant is obliged to treat the property with care and diligence and to maintain the cleanliness of the property. In the case of not complying or not respecting the rules and norms of the community by creating loud noises, playing loud music, damages, loud discussions, fights etc., the Agent may evict the tenant with immediate effect from the property, without any compensation or reimbursement for the days remaining of your stay.
The tenant must leave the house in the same clean and orderly condition that they found it at the beginning of the tenancy.
All refuse must be removed from the property prior to vacating or an additional charge will be made.
If at departure of the tenant, the Agent finds the property in a dirty or messy state, the amount of the corresponding cleaning will be deducted from the security deposit.
8. LOSS OF OBJECTS
The Agent and the property are not responsible in cases of loss or the forgetting of objects by tenants in the property during their stay.
Tenants who have forgotten objects in the property and request the Agent to send them on, must pay the corresponding postal costs.
9. SECURITY DEPOSIT
The security deposit will be paid in accordance with the provisions of article 5 of this document. The amount of the security deposit will be included in the cost breakdown of the reservation.
The security deposit will be returned to the tenant as quickly as possible, but up to a maximum of two weeks after departure, once the house has been inspected and verified that no damage has occurred. If damages have been incurred, the Agent will assess the damages, notifying the tenant in writing of the cost involved and retaining it from the deposit. If the cost of the damage is higher than the deposit retained the tenant is obligated to pay the Agent the difference.
10. DELIVERY OF KEYS
The agent will deliver to the tenant, upon their arrival, two sets of keys to the property.
The complete keys must be returned by the tenant upon departure. Otherwise the Agent will charge the amount of 280€ + VAT to the security deposit.
11. BEDDING AND TOWELS
The property is provided with bed linen, towels and beach towels, corresponding to the number of tenants. Please be aware that bedding or towels should not be used to remove make-up, oils or suntan lotions. In the case of the bedding and towels being found in a deplorable state or with items missing, during or at the end of the tenancy, the cost of replacement will be charged to the security deposit.
12. RIGHT OF ENTRY TO THE RENTED PROPERTY
The agent, its employees or the owner shall be permitted access to the property at all reasonable times, for inspection purposes or to carry out any necessary repair or maintenance.

14. RESPONSIBILITY AND INSURANCE
It is advisable for tenants to purchase their own travel and health insurance.
The tenant’s breach of contract exempts the Agency from all liability for any cause.
